The Structure of the EU AI Act

- Untargeted facial recognition database scraping: Creating or expanding facial recognition databases through untargeted scraping of images from the internet or CCTV footage.
Enterprise leaders should audit their current AI portfolio immediately to confirm that no deployed system falls within these categories. The penalties for prohibited practices are the most severe under the Act.
High Risk: Significant Obligations
High-risk AI systems are those deployed in contexts where they can significantly impact individuals' safety, rights, or access to essential services. The Act identifies two categories of high-risk systems:
Category 1: AI systems used as safety components of products that are subject to existing EU product safety legislation (medical devices, automotive, aviation, machinery, toys, elevators, and similar regulated products). These systems must undergo conformity assessments before market placement.
Category 2: Standalone AI systems deployed in specific high-risk domains, including:
- Biometric identification and categorization of natural persons
- Management and operation of critical infrastructure

AI systems used in HR processes (automated resume screening, performance evaluation, workforce planning), credit and insurance decisions, safety-critical operations, and biometric systems all fall within this tier.
Limited Risk: Transparency Obligations
AI systems classified as limited risk carry primarily transparency obligations. Users must be informed when they are interacting with an AI system, when content has been generated by AI, or when emotion recognition or biometric categorization is being performed. This category covers most customer-facing chatbots, AI-generated content tools, and deepfake generation systems.
The transparency requirements, while less burdensome than high-risk obligations, still require systematic implementation. Organizations must ensure clear disclosure mechanisms are embedded in all AI-powered customer interactions and content generation pipelines.
Minimal Risk: Voluntary Codes of Conduct
AI systems that do not fall into the above categories are classified as minimal risk and are not subject to mandatory obligations. However, the Act encourages providers of minimal-risk systems to voluntarily adopt codes of conduct that align with the high-risk requirements. Obligations for High-Risk AI Systems

Risk Management System
Providers must establish, implement, document, and maintain a risk management system throughout the AI system's lifecycle. This includes identifying and analyzing known and reasonably foreseeable risks, estimating and evaluating residual risks after mitigation, adopting suitable risk management measures, and conducting testing to ensure that risk management measures are effective.
Data Governance
Training, validation, and testing datasets must meet quality criteria defined in the Act. This includes requirements for data relevance, representativeness, completeness, and statistical appropriateness. Organizations must implement data governance practices that address data collection, labeling, preparation, and bias detection. For many enterprises, this requirement will necessitate significant investment in data management infrastructure.
Technical Documentation
Providers must maintain comprehensive technical documentation that demonstrates compliance before the system is placed on the market or put into service. The documentation must include a general description of the AI system, detailed information about the development process, monitoring and functioning details, a description of the risk management system, and information about the measures taken to ensure post-market monitoring.
Record-Keeping and Logging
High-risk AI systems must include automatic logging capabilities that record events throughout the system's lifecycle. Logs must be sufficient to enable traceability of system functioning, identify risks, and facilitate post-market monitoring. Deployers must retain logs generated by the AI system for a period appropriate to the intended purpose, and at minimum six months unless otherwise specified by applicable law.
Transparency and Information Provision
High-risk systems must be designed to ensure that their operation is sufficiently transparent to enable deployers to interpret system output and use it appropriately. Providers must supply deployers with instructions for use that include the provider's identity, the system's intended purpose, the level of accuracy and robustness, known limitations, and human oversight measures.
Human Oversight
High-risk AI systems must be designed to allow effective human oversight during use. This includes the ability for human operators to fully understand the system's capabilities and limitations, correctly interpret outputs, decide not to use the system or override its output, and intervene or interrupt the system. The level of human oversight required is proportionate to the risk and the degree of autonomy of the AI system.
Accuracy, Robustness, and Cybersecurity
High-risk systems must achieve appropriate levels of accuracy, robustness, and cybersecurity. Systems must be resilient against errors, faults, and inconsistencies. They must be robust against attempts by unauthorized third parties to exploit vulnerabilities, including adversarial attacks. Cybersecurity measures must be proportionate to the risks and must address data poisoning, model manipulation, and input perturbation threats.
General-Purpose AI Models: Additional Requirements
The Act includes specific provisions for general-purpose AI (GPAI) models, which became applicable in August 2025. Providers of GPAI models must maintain technical documentation, provide information and documentation to downstream providers, establish a copyright compliance policy, and publish a sufficiently detailed summary of the content used for training.
GPAI models that pose systemic risk (defined by computational power thresholds or Commission designation) face additional obligations including model evaluation, adversarial testing, tracking and reporting of serious incidents, and ensuring adequate cybersecurity protections. Key Timelines and Deadlines
The EU AI Act entered into force on August 1, 2024, with a phased implementation schedule:
- February 2, 2025: Prohibitions on unacceptable risk AI practices take effect. AI literacy obligations apply.
- August 2, 2025: Obligations for GPAI model providers take effect. Member states must designate competent authorities and notify the Commission.
- August 2, 2026: Most provisions become applicable, including obligations for high-risk AI systems listed in Annex III, transparency obligations for limited-risk systems, and enforcement provisions. This is the primary compliance deadline for most enterprises.
- August 2, 2027: Obligations for high-risk AI systems that are safety components of products under existing EU legislation (Annex I) take effect.

- High-risk system obligations: Up to 15 million EUR or 3 percent of global annual turnover, whichever is higher.
- Incorrect information to authorities: Up to 7.5 million EUR or 1.5 percent of global annual turnover, whichever is higher.
For SMEs and startups, the Act provides for proportionate fines that account for their economic viability. However, for large enterprises, the percentage-of-turnover model means penalties can reach into the hundreds of millions or even billions of euros.
Practical Compliance Steps
Translating the EU AI Act into operational compliance requires a structured, multi-phase approach. The following steps provide a roadmap for enterprise compliance teams.
Step 1: AI System Inventory and Classification
Conduct a comprehensive inventory of all AI systems developed, deployed, or procured by the organization. For each system, determine whether it qualifies as an AI system under the Act's definition, classify it according to the risk tier, and identify whether the organization acts as provider, deployer, importer, or distributor. Step 2: Gap Analysis
For each high-risk and limited-risk system identified, conduct a gap analysis against the applicable obligations. Implement logging and monitoring systems, establish data governance practices, develop technical documentation, build human oversight mechanisms, and conduct required conformity assessments. For many organizations, this phase will require the most significant investment of time and resources.
Step 5: Ongoing Monitoring and Adaptation
Compliance is not a one-time activity. Establish post-market monitoring processes, incident reporting procedures, and regular compliance reviews. Monitor regulatory guidance from the European AI Office and national competent authorities for interpretive guidance that may affect your compliance posture. Update your AI system inventory and risk classifications as systems evolve.
Extraterritorial Reach: Who Must Comply
The EU AI Act applies to providers placing AI systems on the EU market or putting them into service in the EU, regardless of where those providers are established. It also applies to deployers of AI systems who are located within the EU, and to providers and deployers located outside the EU where the output produced by the AI system is used in the EU. This extraterritorial scope means that US, UK, and Asian enterprises serving EU customers or operating in EU markets must comply.
Organizations outside the EU that fall within scope must designate an authorized representative established in the EU. This representative serves as the point of contact for regulatory authorities and must be granted sufficient authority and resources to fulfill the role.
The EU AI Act represents a fundamental shift in how AI systems are regulated globally. Its influence is already extending beyond the EU through a "Brussels Effect," as organizations adopt its frameworks globally for operational consistency and because other jurisdictions are developing regulations that draw on its approach. Enterprise leaders who invest in compliance now will be better positioned to operate across jurisdictions, build customer trust, and avoid the substantial penalties that the Act imposes. Those who delay compliance face a narrowing window and an increasingly complex remediation challenge.
